The law which guides employees and the management/use/distribution of their remuneration is the Labour Act, Chapter L1, Laws of the Federation of Nigeria, 2004 and by the said law, it is unlawful for an employer to make any deduction from the remuneration of its employees. It is also unlawful and illegal to make any agreement with the employee for deductions from his remuneration except where such deduction is allowed by law.
For clarity of purpose and intent, some deductions permissible under law are: Taxes (Pay-As-You-Earn), Contributions for National Housing Fund (NHF), Contributions for National Health Scheme (NHS), deductions for the Contributory Pension Scheme and then trade Union contributions with consent of the employee.
Also, even with the permission of deductions by law, such deduction is only limited to 1/3 (One-Third) of the employee’s remuneration for the month and cannot exceed same else it shall be illegal to the extent of the excess.
It is also noteworthy to identify that under a circumstance where an employee was overpaid his remuneration, the sum in excess can be deducted from remuneration of the employee if discovered within 3 (Three) months of the erroneous disbursement. See Section 5 – DEDUCTIONS (INCLUDING DEDUCTIONS FOR OVERPAYMENT OF WAGES) of the Labour Act, Chapter L1, Laws of the Federation of Nigeria, 2004
It can be deduced from the above that any deductions and fines from the employee’s remuneration except deductions allowed by law are illegal and such illegal deductions are: fines for lateness, welfare dues, development levy, cooperatives dues, association fee, celebration levies (birth, death, wedding, send forth), Religious Festivities levies, End of the year party levies, caution fee, destruction charges and any other penalties.
Thus, even where any property of an employer is damaged destroyed or lost by an employee, the employee’s remuneration is not permitted to be deducted from under law unless there is a written consent from an authorized labour officer from government which in this instance would be the Ministry of Labour. See Section 21 – OFFENCES of the Labour Act, Chapter L1, Laws of the Federation of Nigeria, 2004.
Thus, any deductions and fines made from an employee’s remuneration is illegal and unlawful, except for a deduction allowed by law. All existing rules, policies, documents or agreements allowing for deductions from remuneration of an employee or employees apart from deductions allowed by law and an employer who contravenes this law can be adjudged guilty by a competent Court of Records and the said employer may become liable upon conviction to pay fines.
