“Probationary period is a specified time at early stage of employment whereby an employee’s suitability is assessed for continued employment, and also affords the employee an opportunity to also assess the suitability of the employment. In other words, probationary period is akin to courtship period for a new employee and the employer to assess each other for suitability in the new employment relationship. The law is that unless the employer terminates the employment within the probationary period, if it feels that the employee’s conduct and competence are not satisfactory during the probation, the employee is deemed to have been confirmed if he/she continues to work for the employer after the probationary period.” See the case of Dr. Adewunmi Raji v. Justice Nelson Ogbuanya of the National Industrial Court, Lagos, had in the case of MR. ABE ADEWUNMI BABALOLA (CLAIMANT) V. EQUINOX INTERNATIONAL RESOURCES LTD (DEFENDANT) with Suit Number: NICN/166/2015, determined whether an employee under probation is automatically confirmed upon completion of his probationary period.
The Defence in the case had argued that being an unconfirmed employee, the Claimant was not entitled to certain terminal benefits, inclusive of salary in lieu of notice while the Claimant’s counsel had argued that the Claimant’s notice of termination was served beyond the probationary period of six months in his letter of offer and the Claimant had continued working without any query and is thus entitled to the full benefits of an employee in full employment.
The Court in its Judgment had stated as follows: “Unless the employer terminates the employment within the probationary period if it feels that the employee’s conduct and competence are not satisfactory during the probation, the employee is deemed to have been confirmed if he/she continues to work for the employer after the probationary period.”
The Court having held that the Defendant’s retention of the Claimant after the period of probation was deemed to have been confirmed by the Defendant, employees thus now have no worries as to confirmation of employment as they are automatically confirmed upon completion of their probationary period except they are queried or their employment terminated within the period.
